1. Introduction
These Terms and Conditions govern the relationship between Weddings By Tiberious ("Vendor," "we," "our," or "us") and the client ("Client," "you," or "your") engaging in wedding filming and photography services. By signing a contract and using our services, you agree to adhere to these terms.
2. Wedding Arrangements
- The Bride and Groom must submit their wedding day arrangements in the form of a schedule provided by their Wedding Planner prior to the event.
-Any changes to the initial wedding plans must be promptly communicated to the Vendor by the Client.
3. Provided Documentation
- The Client grants the Vendor permission to utilize the wedding film captured under this contract for promotional purposes, including marketing and advertising on websites and social media platforms.
- All documentation produced by the Vendor (including but not limited to photos and videos) is owned and copyrighted by the Vendor and cannot be distributed or used by the Client or third parties without prior written permission.
- The final films and content created for the Client are jointly owned, and the Client may freely use these materials on social media.
4. Destination Weddings
- If the wedding is classified as a destination event (taking place more than 75 miles from Wilmington, NC), additional fees will apply. Such fees may include round-trip airfare, hotel accommodations for the Vendor’s staff, and car rentals- Travel arrangements may be organized either by the Client following the Vendor's specifications or by the Vendor after obtaining agreement on invoicing for the travel expenses.
5. Lodging Accommodations (If Applicable)
- For weddings conducted more than 75 miles from Wilmington, NC, the Client shall provide hotel accommodations (one room with two double beds or two rooms with one double bed each) for the Vendor's staff.
- These accommodations must be within a 10 to 15-mile radius of the wedding venue in a safe location.
6. Liability
- The Vendor's liability is limited to the services rendered as stipulated in this contract; the Vendor cannot be held responsible for the actions or services of other contracted vendors.
- In no instance shall the Vendor be held liable for consequential damages arising from or related to the provided services.
7. Cancellation Policy
- In the event of cancellation, any deposit paid is non-refundable. If the event is canceled less than six months before the scheduled date, the Client shall be responsible for the full payment of the contracted services already initiated.
- If the event is postponed, the contracted services may be applied to the new date if possible (refer to the Postponement Policy).
-All cancellations must be submitted in writing.
8. Postponement Policy
- Should the event be postponed without a new date provided, all services will halt upon notification of the postponement.
- The payment schedule will be recalibrated upon notification of the new event date. A second payment will be required before resumption of services.
9. Responsibility
- The Vendor is not liable for any incidents beyond their control, including but not limited to Acts of God, natural disasters, governmental actions, illness, or other emergencies.
- In the event of such circumstances, the Vendor will seek to replace their services with a qualified professional, subject to the Client's approval, at no additional cost to the Client.
10. Filming on Location
- The Client acknowledges that filming could be impacted by venue restrictions or environmental conditions, and the Vendor will make reasonable efforts to achieve the best results given these constraints.
11. Editing
- The Client allows the Vendor creative discretion in shot composition, direction, and editing. Editing is a time-intensive process that typically requires over 25 hours for a wedding video.
- Minor changes to the edited content may incur additional charges unless they correct a significant error.
12. Overtime
- Any additional services requested beyond those contracted (e.g., major redesigns, day-of extensions) will be classified as overtime and charged at a rate of $100 per hour, subject to prior notification and consent.
13. Contracted Vendors and Payments
- Any rentals or subcontracted vendors arranged on behalf of the Client must be settled in full with the Vendor by the specified deadline.
14. Delivery of Final Video
- The final wedding video will be delivered within a timeframe of 10 to 14 weeks after the event, with any physical wedding albums shipped approximately 2 to 3 weeks thereafter.
15. Payment Schedule and Method
- Payments can be made via credit card online, or by cash or check. An initial deposit of 25% is due within five days of signing the agreement, with the remaining balance due four weeks before the event.
